The Delhi High Court on Tuesday sought actor Salman Khan's response on a plea by the makers of the film "Kala Hiran: The Battle for Legal" to stay the Bollywood star's suit against the release of the movie.
Justice Anup Jairam Bhambhani issued notice to Khan on the application filed by producer Amit Jani, which argues that substantially the same dispute is already pending before the High Court in an earlier suit filed by the actor.
What each side argued
Khan has sought restraint on the release of the film, which he contends is purportedly based on him. In his plea, producer Amit Jani argued that the proceedings amount to parallel litigation concerning the same proposed film, its promotional material and alleged infringement of the actor's personality or publicity rights.
The application stated that Khan has already initiated a suit for protection of his personality rights, in which an ex-parte ad-interim injunction was granted on December 11, 2025. Khan subsequently moved an application seeking interim injunction specifically in respect of the proposed film, and that interim injunction remains pending, the producer said.
Khan's lawyer, Senior Advocate Ravi Prakash, told the court he would file a reply to the application. The court also sought clarification about the nature of the original suit and whether it concerned the actor's personality rights.
Background of the dispute
The controversy dates to June, when the first look of Kala Hiran drew Khan's objection. According to reports, the actor's legal team sent a notice asking the makers not to proceed, after which Khan moved the Delhi High Court, arguing that the film's poster made a clear and obvious reference to him — including a character shown wearing a bracelet similar to his own — and that the project was based on the blackbuck poaching case involving him, in which he was acquitted.
On July 27, a coordinate bench had passed an interim order directing the removal of the film's teaser and other related posts from online platforms after Khan's objection. The film's makers had told the court that the movie was not ready to be released as it was yet to get certification from the censor board, and even the trailer had not been released.
The court has granted Khan's legal team time to file a formal reply as the legal tussle continues.
